Sitting fee

A sitting fee is payable at the time of booking, appropriate to the portrait package you choose, to secure your photo session. This can be paid by cheque, cash, or bank transfer.

Cancellation and re-booking

The sitting fee is non-refundable in the event that you should cancel your booking less than 48 hours before your session. If you have booked an outdoor shoot and prevailing weather conditions mean that the shoot cannot take place (for example because the chosen location is unsafe or inaccessible), the photographer may suggest an alternative location, or re-book your shoot for the earliest mutually convenient date. In the event that the photographer has to cancel your shoot due to other circumstances outside his/her control, such as illness, every effort will be made to reschedule the shoot, but you will be given the option to cancel your session, in which case the sitting fee will be refunded, Diane Finn Photography will have no further liability in respect of this agreement.

Image manipulation

Digital images are individually processed. Minor retouching is a part of the service
offered, but the significant alteration of images may incur an additional charge based on time taken. In this case, costs will be agreed prior to the commencement of any retouching work.

Viewing of images

Diane Finn Photography will make your images available for viewing via an online gallery, which will be password-protected, for a maximum of 21 days. Orders should be made during or shortly after this viewing period.

Products and pricing

Diane Finn Photography offer a range of photographic products. The standard price list is adjusted periodically, and orders will be charged at the prices in effect at the time the order is placed. Special offers may be made available from time to time at the discretion of Diane Finn Photography, and any such offers may be withdrawn at any time without notice.

Ownership, copyright and reproduction of photographic images

Diane Finn Photography retains full, unlimited, world-wide copyright on all photographs supplied. These prints are solely for personal display purposes. They may not be copied, published, reproduced, or stored on any electronic retrieval system without the express written permission of Diane Finn Photography. The sole exception to this is that where images are supplied to the client electronically with reproduction rights, (for example by email or on a digital storage medium) when the client may make unlimited reproductions for their own personal use, but the client is not entitled to alter or manipulate the images in any way. No images supplied by Diane Finn Photography may be used for any commercial purpose, including advertising and any other promotional purpose, without the express written permission of Diane Finn Photography.

Use of images by Diane Finn Photography

Diane Finn Photography reserves the right to use a Client’s images for advertising and promotion of Diane Finn Photography in various media (includes Diane Finn Photography own website), entry in photographic contests or art exhibitions, editorial use, for the creation of samples, or for display within or on the outside of any studio used by the photographer. If you wish to restrict the use of your images in any way, please advise in writing or by e-mail to dfinnphotography@btinternet.com

If Diane Finn Photography wishes to use any of your images for commercial purposes where payment is sought or received, such as the sale of images to photographic libraries, Diane Finn Photography will not do so without first obtaining your written permission.

Photographer

Diane Finn Photography may substitute another photographer to take the photographs in the event of photographer's illness or scheduling conflicts. In the event of such substitution, Diane Finn Photography warrants that the photographer taking the photographs shall be a competent qualified professional.

Match to original. (Likeness to person/colour)

In accordance with the accepted practices of all professional photographers and photographic laboratories, the return of any technically acceptable photographs or prints or demands for refund or refusal to settle charges cannot be entertained
on principle. No exception whatsoever can be made to this rule as we cannot be held responsible for individual tastes or expectations.

Inherent Qualities

Client is aware that colour dyes in digital photography may fade or discolour over time due to the inherent qualities of dyes, and Client releases Photographer from any liability for any claims whatsoever based upon fading or discolouration due to such inherent qualities.

Miscellany

Any modifications of this Agreement must be in writing and signed by both parties.
English Law shall govern this Agreement.
